Liability of Day Care Provider- In Fatal Hit-and Run Accident

When parents entrust their children into a daycare environment, they hope their children will be safe.

Days after the chaos, a family is grieving for the loss of their 4-year old daughter, 14 injured children are recovering, and a man whose car went plowing into a daycare center is behind bars in Florida.

The effects of the tragedy that claimed the life of a 4-year old while she sat waiting for her afternoon snack remains as another child clings to life and two other remain in serious condition.

Reports indicate that the driver crashed into a vehicle, which in turn smashed into the daycare building; he then fled the scene. The driver turned himself into authorities about 24 hours later, and was charged with leaving the scene of a deadly accident. He was being held on $100,000 bond.

Apparently he has a lengthy criminal history, including a misdemeanor charge of leaving the scene of an accident involving damage, a felony charge of selling narcotics, a felony charge of marijuana possession, and he served prison time for trafficking cocaine and extortion.

So many questions remain unanswered, such as, “What motivated the hit-and-run driver to flee the scene, why did this accident end so violently, and why was a man with his extensive record free in the first place – he has gang ties as well?”

My thoughts and prayers are with the families after this tragic accident. My condolences go out to the family of the young victim and I wish the other children a speedy and complete recovery.
