Breaking The Law Continues to Cause Accidents

Texting while driving is the act of composing, sending, reading text messages, email, or making other similar use of the web on a mobile phone while operating a motor vehicle. Texting while driving is prohibited in California.

These laws also prohibit writing, sending or reading messages, such as emails or instant messages while driving. Unfortunately, some drivers ignore this law, causing accidents that should not have happened.

This practice has proven to be dangerous. When a driver takes his or her eyes off the road, even for a split second, it puts that person and others around them in all kinds of danger. Texting while driving leads to increased distraction behind the wheel.

Statistics show that between 300 and 500 distracted motorists were killed in accidents in California in a given year.

According to California Vehicle Code Section 23123.5(a), “A person shall not drive a motor vehicle while using an electronic wireless communications device to write, send, or read a text-based communication.”

If you are found to be texting while driving, the first violation will cost you $20 while subsequent violations are $50. Total costs will vary depending on the addition of local court costs and program fees. If you are involved in an accident, the penalties are the same; however, if texting contributed to the collision, additional charges can be added.

According to a study conducted by the Virginia Tech Transportation Institute, “Texting while driving can increase your accident risk by as much as 23 times”. In addition, the study found that “Texting while driving is the most distracting behavior, much ahead of having a conversation on a cell phone while driving and other distracting behaviors”.

Teen drivers seem to be at a special risk of distracted driving and using cell phones while driving. Police need to set up special enforcement and education initiatives for teen drivers, as well as others.
